David is a Mediator accredited by the Centre For Effective Dispute Resolution (CEDR). David is a keen advocate of the benefits of mediation which is often a more efficient and less destructive alternative to litigation. It is a useful tool in enabling parties to reach lasting settlements which are not imposed by a Court. The CEDR model of mediation applies to any type of dispute ranging from high value commercial cases to family litigation. David is able to act as a mediator in all of these areas. David's training as a mediator also enables him to provide expert legal advice as a mediation advocate in the areas of law set out below:
David qualified as a solicitor in 2005 having completed his training contract at a well known corporate law firm before retraining and joining the Bar. Through his work in both branches of the profession, David has gained considerable experience in all areas of dispute resolution including those relating to contract, agency, partnership, competition and director's duties. He has been responsible for advising clients which range from the boards of household names through to sole traders.
David undertakes work relating to both corporate insolvency and personal bankruptcy. He has gained broad experience in all areas of insolvency which range from appearing at corporate petition hearings and applications to set aside Statutory Demands through to advising on failed IVAs.
David undertakes work in all areas of professional negligence including those relating to advice given by solicitors and surveyors. This includes actions for misrepresentation and breaches of strict warranty in professional agreements. David also has experience of building disputes.
David has a broad experience of both Claimant and Defendant work. He regularly advises on quantum and liability as well as undertaking trial and disposal work. David has gained considerable experience of appearing at Inquests. He is able to advise on fatal accident claims as well as those against the Motor Insurers' Bureau and the Criminal Injuries Compensation Board.
David acts for both commercial and individual clients. He regularly advises on cases involving security of tenure, possession and the interpretation of leases. David also acts on cases in the Leasehold Valuation Tribunal. He is able to advise on matters involving land including the enforceability of restrictive covenants and boundary disputes.
David undertakes a broad range of planning work. He has advised on the merits of a judicial review against a local planning authority and has experience of appearing at planning inquiries.
David accepts instructions in all areas of licensing and entertainment law. He has acted on behalf of a large brewery chain in the defence of its premises licence due to the conduct of the personal licence holder. Further examples of experience include applications to extend licensing hours and to vary licences to include the provision of live music.
David regularly provides advice on claims under the Inheritance (Provision for Family and Dependants) Act 1975. David has acted on behalf of a Respondent wife in a complex matter where the testator husband died following the conclusion of ancillary relief proceedings in which a consent order had been agreed.
